These Terms of Service ("Terms") govern your access to and use of the link shortening and analytics services provided by the domain dco.ink ("Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (Privacy). If you do not agree to all of these Terms, you may not use the Service.

1. Description of Service and Access Tiers

The Service allows users to create shortened URLs using the dco.ink domain and access associated analytics. Access levels are determined by user status:

1.1. Basic Access (Unregistered Users)

  • Functionality: Users without an account can use the basic URL shortening function.
  • Limitations: Unregistered users cannot create advanced/custom short links and cannot view any data analytics or statistics.

1.2. Registered User Access (Logged-in, Free Tier)

  • Functionality: Registered users can create advanced short links Users can view data analytics for their created links.
  • Limitations: Access is limited by a fixed monthly/total quantity of short URLs.

1.3. Paid Subscription Access (Subscribers)

  • Functionality: Subscribers gain access to increased or unlimited short URL creation capacity and full access to all advanced features and comprehensive data analytics.
  • Billing: Subscription fees and cycles are displayed clearly at checkout via Creem.

2. Account, Usage, and Prohibited Conduct

  1. Account Responsibility: Registered users are responsible for maintaining the confidentiality of their passwords and for all activities that occur under their account.
  2. Prohibited Content and Use: You agree not to use the Service to generate any short URL that redirects to content that is:
    • Illegal, fraudulent, libelous, defamatory, obscene, or pornographic.
    • Harmful, abusive, threatening, or promotes discrimination or violence.
    • Designed to spread malware, viruses, phishing scams, or any form of malicious code.
    • Infringes upon the intellectual property rights, privacy rights, or publicity rights of any third party.
    • Redirects to pages containing excessive pop-ups, ads, or scripts that interfere with the user experience.
  3. Monitoring and Termination Rights: We reserve the right to monitor all generated links. We may, at our sole discretion and without prior notice, immediately delete any URL, suspend, or terminate any account found to be in violation of these Terms or which we deem to be abusive or harmful to the Service or its users.

3. Subscription, Cancellation, and Refunds (Creem Integration)

  1. Payment: All payments for subscription services are processed through our payment gateway partner, Creem.io. You authorize Creem.io to charge the applicable fees according to your chosen subscription plan.
  2. Automatic Renewal: Subscriptions will automatically renew at the end of each billing cycle unless cancelled prior to the renewal date.
  3. Cancellation: You may cancel your automatic renewal at any time via your account settings on creem.io. Cancellation will be effective at the end of your current paid billing period; you will retain access until that period expires.
  4. Refund Policy:
    • Refunds are processed in accordance with the policies of our payment processor, Creem.io.
    • We generally do not offer refunds for user-initiated cancellations or simply changing your mind.
    • A refund will only be processed if the system receives a valid refund.created webhook event from Creem.io concerning a transaction you made. Your access rights will be adjusted according to the terms of that specific refund event.
    • For any paid subscription period, refunds will be denied if the user has consumed a significant portion of the allocated resources during that period.

4. Intellectual Property and User Content

  1. Our IP: The Service, including the software, design, logos, and the dco.ink domain, are the exclusive property of [Your Company Name/Service Provider Name] or its licensors and are protected by copyright and trademark laws.
  2. Your Content: By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to access, display, and process the original URLs you submit solely for the purpose of generating the shortened link and providing you with analytics. You warrant that you have the right to use the original URLs you submit.

5. Disclaimers and Limitation of Liability

  1. "AS IS" Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
  2. Limitation of Liability: To the maximum extent permitted by applicable law, DCO.INK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

6. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of DCO.INK, without regard to its conflict of law provisions.
